These Booking Terms & Conditions (“Terms”) apply to travel planning, advisory, itinerary design and booking assistance services provided by Sammy in the Souk (“Sammy in the Souk”, “we”, “us” or “our”).
Please read these Terms carefully before instructing us to plan or arrange any aspect of your trip. By engaging our services, paying any planning or service fee, or asking us to proceed with a booking, you confirm that you have read, understood and agree to these Terms.
These Terms should be read alongside our Privacy Policy and Cookie Policy.
1 About Sammy in the Souk
Sammy in the Souk provides personalised travel planning, itinerary design, recommendations and booking assistance.

Our role may vary depending upon the arrangements we make for you. Unless we expressly state otherwise in writing, our standard service is an advisory and booking-assistance service under which individual travel services are supplied by independent third-party suppliers and paid for by you directly.
2 OUR SERVICE AND YOUR BOOKING
2.1 Our Travel Planning Service
We provide a personalised travel planning and advisory service which may include:
· discussing your travel requirements and preferences;
· researching destinations;
· designing itineraries;
· recommending accommodation;
· identifying suitable flights and other transport;
· recommending restaurants, guides, excursions and activities;
· recommending or arranging transfers;
· checking availability;
· making reservations at your request;
· communicating with travel suppliers on your behalf; and
· providing general destination and travel information.
The exact scope of our service will depend upon the trip and what we have agreed with you.
We may charge a planning, advisory, booking or concierge fee for these services. Any such fee will be explained to you before you instruct us to proceed.
2.2 Our Role and the Role of Travel Suppliers
Sammy in the Souk is not itself an airline, hotel, villa operator, transport provider, tour guide, restaurant, activity operator or other travel service provider unless we expressly tell you otherwise.
Most travel services included or referred to in an itinerary are provided by independent third-party suppliers (“Suppliers”).
These may include, for example:
· airlines;
· hotels and other accommodation providers;
· villa owners or operators;
· rail companies;
· car hire companies;
· transfer providers;
· tour operators;
· local guides;
· restaurants;
· excursion providers;
· activity operators; and
· other travel and hospitality businesses.
Where you book directly with a Supplier, your contract for that travel service is with the Supplier and will be subject to that Supplier's own booking conditions, cancellation policy and other terms.
Where, at your request, we communicate with a Supplier or make a reservation on your behalf, we will ordinarily be acting as an intermediary in arranging the relevant service rather than providing that travel service ourselves.
You authorise us to communicate with Suppliers and, where appropriate, provide them with information reasonably necessary to make or manage reservations on your behalf.
Nothing in these Terms is intended to exclude or restrict any rights or protections that you have under applicable law, including the Package Travel and Linked Travel Arrangements Regulations 2018 where those Regulations apply to your arrangements.
2.3 Packages and Linked Travel Arrangements
Travel law distinguishes between individual travel services, packages and certain linked travel arrangements.
Whether an arrangement constitutes a package or other regulated travel arrangement depends upon the circumstances in which the travel services are selected, offered and booked and not simply upon the terminology used to describe the trip or the fact that individual Suppliers are paid separately.
Our standard travel planning service is designed around individually supplied travel services, normally contracted and paid for directly between you and the relevant Suppliers.
However, where the arrangements we make for you fall within applicable package travel legislation, the rights and obligations imposed by that legislation will apply irrespective of anything in these Terms.
Where we believe that a proposed arrangement requires a different booking structure or additional consumer protection, we may change the way in which we arrange the services, provide you with additional terms or information, or decline to make particular arrangements.
2.4 Making a Booking
Once you have approved a proposed itinerary or individual travel arrangement, you may ask us to proceed.
Depending upon the Supplier and type of service, we may:
· provide you with details or a link so that you can book directly;
· ask the Supplier to contact you for payment;
· reserve the service on your behalf;
· introduce you to the Supplier;
· arrange for you to pay the Supplier directly; or
· use another booking method agreed with you.
A booking is not confirmed merely because it appears in a proposed itinerary.
A travel service is confirmed only when the relevant Supplier has accepted the booking and any payment or other booking requirements have been satisfied.
All bookings are subject to availability.
2.5 Authority to Act on Your Behalf
By asking us to make or assist with a reservation, you authorise Sammy in the Souk to act on your behalf to the extent reasonably necessary to arrange that reservation.
This may include providing Suppliers with:
· traveller names;
· contact information;
· dates of birth;
· passport information where required;
· dietary requirements;
· accessibility requirements;
· accommodation preferences; and
· other information necessary to provide the requested service.
Where you make a booking on behalf of other travellers, you confirm that you have authority to provide their information to us and to accept these Terms on their behalf.
You are responsible for ensuring that all members of your party are aware of these Terms and of any Supplier terms applying to their bookings.
3 PRICES AND PAYMENTS
3.1 Our Planning and Service Fees
We may charge a fee for researching, designing, arranging or managing your trip.
The amount and basis of any fee will be communicated to you before you instruct us to proceed.
Unless we tell you otherwise, our planning or service fee relates to the professional time and work involved in researching and creating your trip and is separate from payments for travel services.
Once we have commenced substantive work on your itinerary, our planning or service fee is normally non-refundable, including if you subsequently decide not to travel, subject to your statutory rights.
If you request substantial changes after an itinerary has been agreed, we reserve the right to charge an additional fee. We will tell you about any additional fee before undertaking the additional work.
3.2 Payments to Suppliers
Under our standard service, you pay Suppliers directly for the travel services they provide.
Unless we expressly agree otherwise, Sammy in the Souk does not receive or hold money on behalf of Suppliers and does not hold customer money intended to pay for hotels, flights or other travel services.
The Supplier is responsible for providing any appropriate invoice, receipt or payment confirmation relating to its services.
Payments to overseas Suppliers may be made in foreign currencies and may incur:
· exchange-rate differences;
· card-provider charges;
· foreign transaction fees; or
· other bank or payment-provider charges.
These charges are your responsibility.
3.3 Prices and Quotations
Travel prices can change rapidly and are normally subject to availability until a booking has been confirmed.
Prices included in an itinerary or quotation may therefore change before booking.
Unless expressly stated otherwise, quoted prices may not include items such as:
· local or tourist taxes;
· resort fees;
· baggage charges;
· seat reservation charges;
· gratuities;
· visa fees;
· airport charges payable locally;
· optional excursions;
· meals and drinks not specifically included; or
· other locally payable charges.
We will take reasonable care to identify material additional charges of which we are aware.
Where prices are quoted in a currency different from your own, the final amount charged by your card issuer or bank may differ because of exchange-rate movements or fees.
4 YOUR RESPONSIBILITIES
4.1 Checking Your Booking
You are responsible for checking all booking confirmations and travel documents as soon as you receive them.
In particular, please check:
· passenger names;
· spelling;
· dates of birth where applicable;
· travel dates;
· flight times;
· departure and arrival airports;
· accommodation;
· room type;
· number of guests;
· transfers;
· activities; and
· any special requests.
Names used for airline and other transport bookings should match the relevant traveller's passport or identification document.
You must tell us or the relevant Supplier immediately if anything appears incorrect.
We cannot accept responsibility for costs resulting from incorrect information supplied by you or from errors which you fail to identify within a reasonable period after receiving confirmation.
4.2 Passports, Visas and Entry Requirements
It is your responsibility to ensure that every traveller has all documentation necessary for the trip.
This may include:
· a valid passport;
· appropriate passport validity;
· visas;
· Electronic Travel Authorisations or equivalent permissions;
· evidence of onward or return travel;
· parental consent documentation;
· driving permits;
· vaccination certificates; and
· any other entry or transit documentation.
We may provide general information or point you towards relevant official guidance, but entry requirements can change at short notice.
You should check the latest requirements applicable to your nationality, personal circumstances, destination and any transit countries before booking and again before travel.
We are not responsible where a traveller is refused entry, boarding or transit because they do not hold the required documentation, except to the extent that the failure results directly from incorrect information negligently provided by us.
4.3 Health, Vaccinations and Medical Requirements
You are responsible for considering the health implications of your destination and proposed activities.
You should obtain appropriate medical advice sufficiently in advance of travel, particularly in relation to:
· vaccinations;
· medication;
· infectious diseases;
· pregnancy;
· altitude;
· allergies;
· existing medical conditions; and
· activities requiring a particular level of health or fitness.
Where you travel with prescription medication, you should check any restrictions on bringing that medication into your destination or transit countries.
Any health information we provide is general travel information and is not medical advice.
4.4 Travel Insurance
We strongly recommend that every traveller obtains comprehensive travel insurance as soon as bookings are made.
Your insurance should be appropriate for your individual circumstances, destination and planned activities and should normally provide suitable cover for:
· cancellation and curtailment;
· emergency medical treatment;
· repatriation;
· personal accident;
· baggage and personal possessions;
· travel delays and disruption;
· personal liability; and
· any sports, excursions or activities you intend to undertake.
You are responsible for ensuring that your policy provides adequate cover, including for any existing medical conditions that need to be declared.
Unless expressly stated otherwise, Sammy in the Souk does not provide insurance advice, recommend a particular insurance policy or assess whether an insurance product is suitable for you.
Failure to obtain appropriate insurance is at your own risk.
4.5 Foreign Travel Advice and Safety
Conditions in destinations can change before or during travel.
You should monitor official travel advice issued by the UK Foreign, Commonwealth & Development Office and any relevant authorities for your destination.
Advice may relate to matters including:
· security;
· terrorism;
· civil unrest;
· weather;
· natural disasters;
· health risks;
· local laws;
· border restrictions; and
· areas where travel is discouraged.
Ultimately, the decision whether to travel remains yours.
Where official advice changes materially after booking, we will provide reasonable assistance where requested, but your rights to cancellation, refunds or alternative arrangements may depend upon the applicable Supplier terms, insurance policy and any statutory rights.
4.6 Special Requirements, Accessibility and Dietary Requirements
Please tell us before booking about any important requirements affecting a member of your party.
These might include:
· reduced mobility;
· wheelchair access;
· medical conditions;
· allergies;
· dietary requirements;
· religious dietary requirements;
· pregnancy;
· hearing or visual impairments; or
· other requirements relevant to the trip.
We will use reasonable efforts to communicate such requirements to the relevant Suppliers.
However, unless expressly confirmed by the Supplier, a request cannot be guaranteed.
Standards of accessibility, food preparation and allergy management vary considerably between countries and Suppliers. Travellers with serious allergies or medical requirements should make appropriate independent enquiries and take necessary precautions.
4.7 Children and Travellers Under 18
Parents and guardians are responsible for ensuring that children and young people travelling with them have all required documentation and permissions.
Some destinations, airlines and border authorities require additional documentation where:
· a child travels with only one parent;
· a child travels without either parent;
· the child's surname differs from that of the accompanying adult; or
· parental responsibility is shared.
It is your responsibility to establish and comply with these requirements.
Parents and guardians remain responsible for the supervision and safety of children in their care throughout the trip.
5 CHANGES, CANCELLATIONS AND DISRUPTION
5.1 Changes Requested by You
If you wish to change a confirmed booking, please contact us as soon as possible.
We will provide reasonable assistance but cannot guarantee that a Supplier will permit a change.
Changes may be subject to:
· Supplier amendment charges;
· fare differences;
· cancellation and rebooking costs; and
· additional Sammy in the Souk service fees where significant additional work is required.
We will explain any fee charged by us before carrying out material additional work.
5.2 Cancellation by You
If you decide to cancel your trip or an individual travel service, please notify us and the relevant Supplier as soon as possible.
Supplier cancellation terms will apply to bookings made with that Supplier.
Depending upon those terms and the date of cancellation, you may lose some or all amounts paid to the Supplier.
Our own planning or advisory fees are separate from Supplier charges. Unless otherwise agreed or required by law, fees relating to work already performed by Sammy in the Souk are not refundable simply because you cancel your trip.
You should contact your travel insurer promptly where cancellation may be covered by your policy.
Nothing in this clause affects any statutory cancellation or refund rights you may have.
5.3 Changes or Cancellations by Suppliers
Airlines, accommodation providers and other Suppliers may occasionally change or cancel confirmed arrangements.
Where we become aware of a material change affecting a booking with which we have assisted, we will use reasonable efforts to notify you and help you understand the options offered by the Supplier.
Where your contract is directly with the Supplier, the Supplier's terms and applicable law will normally determine your rights to:
· a refund;
· alternative arrangements;
· rebooking;
· compensation; or
· other remedies.
Where applicable package travel legislation makes Sammy in the Souk responsible for the performance of an arrangement, your statutory rights under that legislation will apply and are not restricted by this clause.
5.4 Unavoidable and Extraordinary Circumstances
Travel can be affected by events outside the reasonable control of Sammy in the Souk or the relevant Supplier.
These may include, for example:
· severe weather;
· flood, fire or natural disaster;
· earthquake or volcanic activity;
· epidemic or pandemic;
· war or threat of war;
· terrorism;
· civil unrest;
· government action;
· border closure;
· airspace closure;
· strikes;
· transport disruption;
· airport closure;
· power or communications failure; or
· other unavoidable and extraordinary circumstances.
Where such an event occurs, we will provide reasonable assistance in relation to arrangements we have helped you make.
Refund, cancellation and rebooking rights will depend upon the circumstances, the relevant Supplier terms and applicable law.
Nothing in these Terms removes statutory rights that apply in such circumstances.
6 SUPPLIERS, DESTINATIONS AND ACTIVITIES
6.1 Accommodation and Destination Standards
Accommodation ratings and standards vary between countries.
Star ratings and descriptions may be provided by Suppliers, local authorities or independent rating organisations and should not necessarily be regarded as directly equivalent to UK standards.
We take reasonable care when researching and recommending accommodation, but facilities, ownership, management, menus, opening hours and other characteristics may change.
Images and descriptions are intended to give a reasonable representation but cannot guarantee that every element will be exactly as shown.
6.2 Restaurants
Where we recommend or reserve restaurants, the restaurant remains solely responsible for the food, drink and hospitality services it provides.
Menus, prices and opening times may change.
If you have food allergies or dietary requirements, you should tell us and the restaurant, but you remain responsible for satisfying yourself that the restaurant can safely meet your requirements.
Restaurant cancellation or no-show charges are governed by the restaurant's terms.
6.3 Excursions, Activities and Guides
Excursions, tours, activities and guiding services may be operated by independent local Suppliers.
Participation in certain activities carries inherent risks.
These may include activities such as:
· hiking;
· cycling;
· horse riding;
· water sports;
· boating;
· diving;
· skiing;
· adventure activities; and
· travel in remote areas.
You are responsible for deciding whether an activity is suitable for you and members of your party, taking account of health, fitness, experience and local conditions.
You should ensure your travel insurance covers any activities you intend to undertake.
Where an activity is provided by an independent Supplier, that Supplier is responsible for operating the activity in accordance with its contractual and legal obligations.
6.4 Local Laws and Customs
Travellers are responsible for complying with the laws and regulations of the countries they visit.
Local laws and customs may differ significantly from those in the United Kingdom.
We recommend familiarising yourself with relevant local laws, cultural expectations, dress requirements and restrictions before travelling.
7 PROBLEMS AND COMPLAINTS
7.1 Problems During Your Trip
If you encounter a problem with a travel service while away, you should raise it with the relevant Supplier as soon as reasonably possible.
Many issues can be resolved more effectively while you are still at the destination.
You should also contact Sammy in the Souk where you would like our assistance.
We will make reasonable efforts to help resolve problems relating to arrangements we have helped you make, although we cannot guarantee a particular outcome where the service is controlled by an independent Supplier.
You should retain relevant evidence such as photographs, receipts, correspondence and booking confirmations.
7.2 Complaints
If you wish to complain about our service, please contact:

Please provide:
· your name;
· booking or itinerary details;
· a description of the issue;
· relevant correspondence or supporting information; and
· the resolution you are seeking.
We aim to acknowledge complaints promptly and investigate them fairly.
If your complaint concerns a service provided directly by a Supplier, you may also need to pursue the matter with that Supplier.
8 LIABILITY
8.1 Our Responsibility to You
We will perform our travel planning and advisory services with reasonable care and skill.
Where we act solely as an intermediary in arranging a service provided under a direct contract between you and an independent Supplier, we are not responsible for the Supplier's acts or omissions merely because we recommended the Supplier or assisted with the booking.
However, we remain responsible for our own negligence, breach of contract and other obligations imposed upon us by law.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
· death or personal injury caused by our negligence;
· fraud or fraudulent misrepresentation; or
· any statutory liability which cannot lawfully be excluded or restricted.
Where the Package Travel and Linked Travel Arrangements Regulations 2018 or other mandatory travel legislation makes us responsible for the performance of travel services, those statutory responsibilities will apply.
8.2 Information and Recommendations
Our recommendations are based upon a combination of professional judgement, experience, research, Supplier information and information available to us at the time.
Travel is inherently subjective. A hotel, restaurant, destination or activity that suits one traveller may not suit another.
We therefore cannot guarantee that every recommendation will meet every personal preference.
We will, however, take reasonable care to understand the requirements you communicate to us and to make recommendations accordingly.
8.3 Events Outside Our Control
We are not responsible for loss caused by circumstances outside our reasonable control except where applicable law provides otherwise.
This does not affect any statutory rights you may have against a Supplier or against us.
8.4 Your Responsibility to Minimise Loss
If something goes wrong, you should take reasonable steps to minimise avoidable loss.
For example, you should notify us or the relevant Supplier promptly rather than allowing a correctable problem to continue unnecessarily.
You should retain receipts for reasonable additional expenditure where you intend to seek reimbursement from a Supplier, insurer or other party.
9 PERSONAL INFORMATION
9.1 Personal Data
We process personal information in accordance with our Privacy Policy.
Arranging travel will frequently require us to share personal information with Suppliers.
Those Suppliers may be located outside the United Kingdom and may be subject to different data protection regimes.
We will only share information reasonably required to provide or arrange the services you have requested or where otherwise permitted or required by law.
Please see our Privacy Policy for further information about how we collect, use, store and share personal information.
9.2 Information About Other Travellers
If you provide us with personal information about another traveller, you confirm that you have authority to provide that information for the purposes of arranging the trip.
Where appropriate, you should make that traveller aware of our Privacy Policy.
Please take particular care before sending us sensitive information about another person, such as health, medical, accessibility or dietary information.
10 GENERAL TERMS
10.1 Website and Itinerary Content
Information on our website and in itineraries is provided in good faith and we take reasonable care to keep it accurate.
However, travel information changes frequently.
Opening hours, prices, schedules, facilities, attractions, restaurants and other services may change without notice.
You should therefore regard time-sensitive information as correct when researched but subject to change.
10.2 Intellectual Property
Unless otherwise stated, itineraries, written travel plans, guides and other original materials created by Sammy in the Souk remain our intellectual property.
You may use material supplied to you for your own personal travel purposes and share it with members of your travelling party.
You may not reproduce, publish, sell or commercially exploit our materials without our prior written permission.
10.3 Communications
We will normally communicate with you by email, telephone, messaging service or another method agreed with you.
You are responsible for providing accurate contact details and monitoring communications relating to your trip.
Important travel communications may occasionally require a prompt response.
We are not responsible for consequences caused by your failure to read or respond to communications within a reasonable period.
10.4 Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where necessary, removed.
The remaining provisions will continue in effect.
10.5 No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
10.6 Third-Party Rights
Except where expressly provided by law, no person other than you and Sammy in the Souk has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
10.7 Changes to These Terms
We may update these Terms from time to time, including to reflect changes in our services, business model or applicable law.
The Terms applying to your engagement will normally be those provided or made available to you when you instruct us, subject to any subsequent changes expressly agreed with you or required by law.
The latest version will be published on our website with its revision date.
10.8 Governing Law and Jurisdiction
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will retain any mandatory rights available to you under the laws applicable to you.
The courts of England and Wales will have jurisdiction, subject to any mandatory consumer rights relating to jurisdiction.
11 IMPORTANT TRAVEL REMINDERS
Before travelling, please ensure that you have:
· checked that names on bookings match passports;
· checked passport validity;
· obtained all necessary visas and travel authorisations;
· checked official travel advice;
· obtained appropriate travel insurance;
· checked health and vaccination advice;
· disclosed relevant accessibility or dietary requirements;
· checked your flight and transfer arrangements;
· reviewed Supplier cancellation terms; and
· retained copies of important travel documents and emergency contact details.
12 ACCEPTANCE OF THESE TERMS
By instructing Sammy in the Souk to commence planning work, paying our planning or service fee, or asking us to proceed with travel arrangements, you confirm that you have read and accept these Booking Terms & Conditions.
Where you are booking on behalf of other travellers, you also confirm that you have authority to make arrangements on their behalf and will make them aware of the terms relevant to their travel services.
